I don't think they have the right to take that away.
They do not.
but they think they do and that is dangerous
They don't have the right to deny due process either. Still happening.
"privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it."
That's the wording in the constitution. They just say that undocumented migrants amount to an invasion and they can suspend it.
It's not like the supreme court is going to override them on that.
They have any and every "right" that no one denies them by actual force of action. The courts will wag their finger and the administration will say "You're a Marxist, I don't have to listen to you. Fuck you."
