A Simcoe, Ont. woman is facing an assault with a weapon charge after she said that she accidentally sprayed her neighbour with a water gun over the Labour Day weekend, a situation that at least one legal expert says amounts to an ‘unfortunate waste of resources.’

17 0 ReplyProsecutors have the discretion to not bring charges, which just makes this situation even more ridiculous.
Edit: I missed the part where this was in Canada, I’m not sure if prosecutorial discretion is a thing there.

The judge can have it thrown out
2 0 ReplyRegular people don’t bring charges in the States either. The Prosecutor will sometimes take what they want into account, but it’s not required.
