Well the gun was his responsibility, so I would say he did accidentally shoot the child. It was with a blank, but those can and do still harm and kill people.

The child received a "deep laceration" and was taken to hospital, far beyond a "slap". The police didn't hold the man responsible because there was no need to and that's how it works. He still faces potential charges, including possible jail time.
