  • Sure, I agree with nearly everything you said.

    Except that on a German instance you must abide German laws. If it were a Belgian instance, Belgian laws would have to be followed. You can call anyone and anything a nazi outside of instances hosted by Germans.

    For similar reasons, calls for the death of billionaires are removed on lemmy.world because that violates laws where that instance is hosted.

    The Radbruch formula is not bullshit though, as it explicitly defines when disobedience of laws is mandatory. Slightly infringing on freedom of speech is not a valid reason, as it doesn't violate fundamental rights that cannot ever be restricted by laws - most notably the freedom to live and being free of bodily harm.

  • There is no issue with rewarding work with luxury while still providing everyone with the necessities to survive - such as a basic home and food.

    Besides, you can reduce unemployment by just reducing working hours. 40 hours per week is way too much frankly. Why not 30 or even 20? That way everyone has more free time which results in better health and more productivity.

  • If following a law slightly restricting freedom of speech - which is fully compatible with the German constitution may I add - ensures the existence of the instance, then yes, following this law is a moral good.

    Besides, wrong laws should be followed, provided the law is not unjust in its very foundation (such as a law mandating the dealth penalty). That's the Radbruch formula which is a core of German jurisprudence since WW2 which allows for prosecution of "legal" crimes and mandates disobedience of unjust laws.

    This current law - or rather the interpretation of it - is objectively wrong. Its foundation - the criminalization of antisemitism and Holocaust denial - however is not unjust in its very being.

    You can be assured feddit.org will never follow any "law, no matter how wrong it is" - as that would be illegal.

    The comment doesn't doesn't draw a parallel to nazis nor does it call for an end to Israel, therefore it is completely fine both by German law and the moderator's actions.

  • If one genocide is lesser in scale or severity it can be (and has been) argued it is downplaying it.

    There are very few genocides you can directly compare to the Holocaust as its scale and speed was unprecedented even for the time.

    I'm unsure you can compare any other genocide to the Holocaust in accordance with German law.

  • Have you read the post? There are 3 things you cannot say about Israel:

    1. Israel is as bad as the nazis
    2. Calling for the (violent) destruction of Israel
    3. The slogan "From the river to the sea"

    Anything else has zero risk and can be freely said.

    The first one is objectively speaking a hyperbole so it's not necessary for discussions. Use any other genocide to draw a parallel to such as the US's genocide of the indigenous population. The second one can be interpreted too vaguely but you're save if you just put the word "peaceful" anywhere when advocating for a one state solution. The third one is a slogan that shouldn't be banned but is, so just don't say it.

    Yes, this law is too broad and designed to criminalize discussion about Israel. In a moderated forum this law is trivial to follow without changing the message behind any comment.

    Gefühlt hat die Bahn im Hinblick Barrierefreiheit die Schulnote 5. Wenn Rollstuhlfahrer durchschnittlich so viel Bahn fahren würden, wie Nicht-Rollstuhlfahrer würde vermutlich die Zugpünktlichkeitsquote auf 10% oder so sinken.

  • Sorry, I meant either confiscation of the domain or the server provider deciding to take everything down. The latter can be mitigated with backups but it will nevertheless result in long downtimes.

    There's generally no legal recourse or protection if any instance involved in hosting the site decides to break contracts. This sort of uncertainty sucks and has to be taken into consideration.

  • Simultaneously, you lose all rights to the site and risk a hostile takeover with no possible recourse.

    It's also significantly more effort to retain this level of anonymity from a state actor. I don't even think there's a single Lemmy instance which follows all those steps.

    The thing is, as of right now German censorship doesn't warrant this. Yes, it sucks you cannot freely speak about Israel. But frankly, since it only requires you to adjust your wording minimally without changing the message ("Israel should be destroyed" => "I support a one state solution where everyone in current-day Israel and Palestine can live freely, similar to how South Africa abolished apartheid.") it's really not worth it.

    Should Germany turn fascist and ban all opposition, it is too late for feddit.org and their moderators anyways. If Germany doesn't, feddit will be fine like this and reduce the strictness of these rules as German sentiment towards Israel slowly worsens over the coming years.

    You can't become anonymous and retain site ownership. The site would've needed to be shut down and a new, somehow completely unrelated site would have to be started.

    Besides, even if that were done you bet your ass a random German lawyer would immediately sue the new site for violating Impressumspflicht. That's one quick way to get the police investigating your site. Your OPSEC better be close to "hosting an illegal streaming site" level.

    Even German forums about piracy would rather have an impress and remove illegal content than remain anonymous and evade police - see tarnkappe.info.

  • Honestly, it does sound a bit like a hardware defect somewhere. Usually everything should work OOTB unless you are doing something really specific.

    If you haven't already done so, try updating the BIOS.

    You mentioned the RAM being fine - have you run Memtest86+ for several hours? One pass is usually not enough to rule out memory malfunctions.

    If you have a spare drive, try installing Linux Mint on it. If it still crashes, you can rule out Windows (and if it doesn't, you could install a clean Windows on that same drive and try again).

    You could also purchase a cheap AM4 motherboard (they start at like 60 bucks) to check if the issues still occur and refund it within the return window.

    I definitely remember reading a bunch of gruesome children stories as a child (and they were great)! Struwwelpeter and Max und Moritz are two funny children books with a couple of deaths.
