Teachers generally have an annual contract, which both sides need to comply with. While US doesn’t have much in the way of worker protections, generally if an employee has a policy, they need to follow it.
So it seems like a clear legal situation: either she signed a contract agreeing to a policy she was violating, or the employer is violating their own policy for the PR. Of course, I’m sure the real issue is likely a wide open generic policy that can include anything they want, so the legal argument would be whether it was well specified
