There is no reason for SCOTUS to rule on this issue. It has nothing to do with them. They have no army, they are not legislative or executive. There is no actual rule that says we have to listen to them at all. In other words, we don't need right wing judges to tell us we can do it. We also don't need a law to say we can do it. We can just do it.

It is not clear whether a second term will make Biden more or less likely to crack down on the southern border. The good money says that he will be more likely to yield to his party’s far-left in pursuing paths to employment, citizenship and other measures for undocumented persons.

I actually do expect him to get more aggressive than he and his "leftwing" party has been.
